It is a labor right that is guaranteed by the Federal Constitution. There are many cases in which workers habitually alternate their work schedules. For example, they work during the day for a month; the following month in the afternoon; and the following month, at night. This generates greater wear and tear on the worker, who even has his personal life compromised.
As a result, the Constitution guarantees this worker a maximum working day of 6 hours per day, and not 8 hours per day, as is more common.
In other words, this worker has the right to receive overtime from the 6th hour of the day and not from the 8th hour.
